Terms of Service

Last updated: October 1, 2026 · Effective immediately

1. Acceptance of Terms

By creating an account or using the OneStack platform, you agree to these Terms of Service and our Privacy Policy. If you are using OneStack on behalf of an organization, you represent that you have authority to bind that organization to these terms.

If you do not agree to these terms, do not use our services.

2. Services

OneStack provides game server hosting including game server instances, storage, networking, DDoS protection, backup services, and associated management tools. We reserve the right to modify, discontinue, or add features at any time with reasonable notice.

Certain features may be in beta or preview. Beta features are provided "as is" and may change or be removed.

3. Your Account

You are responsible for all activity that occurs under your account. You must keep your credentials secure and notify us immediately through the contact page if you believe your account has been compromised.

You must provide accurate registration information and keep it up to date. Accounts may not be shared between individuals; each person who accesses OneStack must have their own account. You may grant access to team members through the dashboard's access controls.

4. Acceptable Use

You may use OneStack only for lawful purposes. You may not use our infrastructure to:

  • Send unsolicited bulk email (spam) or operate spam infrastructure
  • Launch denial-of-service attacks or network intrusion attempts against any target
  • Host, distribute, or transmit illegal content including CSAM
  • Conduct cryptocurrency mining that violates plan resource limits
  • Resell or sublicense access to OneStack services without our written consent
  • Attempt to circumvent or probe the security of other customers' infrastructure

Violations may result in immediate account termination without refund.

5. Payment & Billing

Plans are billed in advance at the start of each billing cycle (monthly or annual). All prices are in USD and exclude applicable taxes.

If a payment fails, we may suspend your servers until it is paid. Servers that stay suspended may be deleted after a reasonable period, and we will try to contact you first.

Refunds are described in our refund policy: a first order can be refunded within 7 days, and after that refunds are at our discretion.

6. Availability

We work to keep your server running, but we do not guarantee a specific level of uptime. Servers may be unavailable from time to time, for example during maintenance, because of problems with our providers or network, or because of events outside our control.

Current service information is on the status page. If you have a problem with your server, open a support ticket.

7. Your Data

You own all data stored on your servers and volumes. We do not access the contents of your instances except to provide support at your explicit request, comply with law, or investigate violations of these Terms.

You are responsible for backing up your own data. While we offer an automated backup service, it does not substitute for your own disaster recovery planning.

8. Intellectual Property

OneStack and its associated trademarks, logos, and service marks are owned by OneStack, Inc. These Terms do not grant you any right to use our branding. Open-source components used in the platform are governed by their respective licenses.

You grant OneStack a limited license to host, store, and transmit your data solely as required to provide the services you've purchased.

9. Limitation of Liability

Please read carefully. To the maximum extent permitted by law, OneStack's total liability to you for any claim arising from these Terms or the services is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunity.

Nothing in these Terms limits our liability for fraud, gross negligence, death, or personal injury caused by our acts or omissions.

10. Termination

You may cancel your account at any time from the dashboard. Cancellation takes effect at the end of your current billing period; your servers remain accessible until then.

We may suspend or terminate your account immediately for violations of the Acceptable Use Policy, non-payment, or if continued access poses a security risk to other customers. Where possible, we will provide 30 days' notice for terminations not related to policy violations.

11. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes will be resolved in the courts of New York County, NY, and you consent to personal jurisdiction there.

For EU/EEA customers, mandatory local consumer protection laws apply where they provide greater protection than these Terms.

12. Changes to These Terms

We may update these Terms from time to time. If the changes are material, we will email registered users at least 30 days before the new Terms take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
